1. The Game

Am I Dead? is a free daily trivia game in which players guess whether famous people are alive or dead. A new puzzle is available each day. The Game includes features such as scoring, streaks, leaderboards, and shareable results.

2. Eligibility

You must be at least 13 years old to use the Game. By using the Game, you represent that you meet this requirement.

3. User Conduct

When using the Game, you agree not to:

• Use offensive, misleading, or impersonating display names
• Attempt to manipulate scores, streaks, or leaderboard rankings through automated means, multiple accounts, or other forms of cheating
• Interfere with or disrupt the Game's infrastructure
• Use the Game for any unlawful purpose
• Scrape, crawl, or harvest data from the Game without permission

We reserve the right to remove display names, reset scores, or restrict access for violations of these terms.

4. Game Content and Accuracy

The Game presents factual information about whether public figures are alive or dead. While we make reasonable efforts to ensure accuracy, we do not guarantee that all information is correct or current at all times. The Game is for entertainment purposes only.

The inclusion of any person in the Game does not imply any endorsement, affiliation, or relationship with that individual. All factual information presented is publicly available.

5. Intellectual Property

All content, design, code, illustrations, and branding associated with the Game are the property of Bandito Software LLC and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written permission.

You are granted a limited, non-exclusive, non-transferable license to access and use the Game for personal, non-commercial purposes.

6. User-Generated Content

By submitting a display name or any content through the Game (including contact form messages), you grant us a non-exclusive, royalty-free license to display that content in connection with the Game (for example, on the leaderboard). You retain ownership of any content you submit.

7. Disclaimer of Warranties

The Game is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Game will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of game content.

8. Limitation of Liability

To the maximum extent permitted by law, Bandito Software LLC and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Game, including but not limited to loss of data, loss of streaks, or inaccurate game content.

Our total liability for any claim arising from your use of the Game shall not exceed $50.

9. Indemnification

You agree to indemnify and hold harmless Bandito Software LLC, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Game or violation of these Terms.

10. Modifications to the Game and Terms

We reserve the right to modify, suspend, or discontinue the Game (or any part of it) at any time without notice. We may also update these Terms from time to time. We will indicate the date of the most recent update at the top of this page. Your continued use of the Game after changes are posted constitutes your acceptance of the updated Terms.

11. Termination

We may restrict or terminate your access to the Game at any time, for any reason, without notice or liability.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws provisions. Any disputes arising from these Terms or the Game shall be resolved in the courts located in Fulton County, Georgia.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bandito Software LLC regarding your use of the Game.
